HB 2434 Health benefits exchange; intent to develop.
Introduced by: Terry G. Kilgore | all patrons ... notes | add to my profiles
SUMMARY AS ENACTED WITH GOVERNOR'S RECOMMENDATION: (all summaries)
Health benefits exchange; intent to develop. States that it is the intent of the General Assembly that the Commonwealth create and operate its own health benefits exchange or exchanges that meet the relevant requirements of the federal Affordable Care Act. The Virginia Exchange shall ensure that no qualified health insurance plan sold or offered for sale through an exchange provides coverage for abortions, except for an abortion performed when the life of the mother is endangered by a physical disorder, physical illness, or physical injury, including a life-endangering physical condition caused by or arising from the pregnancy itself, or when the pregnancy is the result of an alleged act of rape or incest. The Governor and the State Corporation Commission's Bureau of Insurance are requested to work with the General Assembly, relevant experts, and stakeholders generally to provide recommendations for consideration by the 2012 Session of the General Assembly regarding the structure and governance of the Virginia Exchange. The recommendations are due by October 1, 2011. The measure states that it shall not be construed or implied to recognize the constitutionality of the 2010 federal health care reform legislation. It further states that it constitutes the election of the Commonwealth to prohibit abortion coverage in qualified health plans offered through an exchange. The measure will expire on July 1, 2014.
