Be it enacted by the General Assembly of Virginia:

1.  § 1. Notwithstanding the provisions of §§ 32.1-102.3 and 32.1-102.3:2 of the Code of Virginia, the construction of an outpatient radiation therapy facility, and the updating of equipment for such facility, pursuant to a 1993 settlement agreement with the State Health Commissioner declaring that such facility was exempt from certificate of public need requirements, shall not be considered a project as defined in § 32.1-102.1 of the Code of Virginia, and shall therefore be exempt from the requirements of Article 1.1 (§ 32.1-102.1 et seq.) of Chapter 4 of Title 32.1 of the Code of Virginia.
