A BILL for the relief of certain employees of the Prince William Health Department.

Whereas, over 100 employees of the Prince William Health Department have been either underpaid or overpaid their annual salary; and

Whereas, these overpayments and underpayments were the result of breaches of departmental policy as well as  improprieties on the part of the business manager; and

Whereas, those employees who were overpaid (excluding the business manager) were not aware that their pay levels were incorrect and made spending decisions based on what they thought was their real salary; and

Whereas, under Virginia law, the Prince William Health Department is required to obtain repayments from those who were overpaid; and

Whereas, these repayments will present a financial hardship for the 47 employees who will not only have their salaries reduced but will also have to pay back moneys overpaid to them; and

Whereas, a budget amendment has already been prepared which reduces state funding in the amount of $53,618 for the Health Department—the amount of the overpayment made to the 47 individuals; and

Whereas, the underpaid employees will be compensated by the Department, but the 47 overpaid employees have no other means to obtain adequate relief except by action of this body; now, therefore,

Be it enacted by the General Assembly of Virginia:

1.  § 1. That the $53,618 of overpayments made to the 47 individuals employed by the Prince William Health Department are hereby forgiven upon execution of a release of all claims each of the 47 employees may have against the Commonwealth or any agency, instrumentality, officer, employee, or political subdivision in connection with the aforesaid occurrence.
