11104210DBe it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding in Chapter 25 of Title 2.2 an article numbered 10, consisting of sections numbered 2.2-2537, 2.2-2538, and 2.2-2539, as follows:
§ 2.2-2537. Governor's Transportation Regulatory Review Commission; membership; terms; compensation.
A. The Governor's Regulatory Review Commission (the Commission) is established as an advisory commission, within the meaning of § 2.2-2100, in the executive branch of state government.
B. The Commission shall consist of four members appointed by the Governor to serve at his pleasure.
Each member shall serve a five-year term. All vacancies shall be filled for the balance of the unexpired term in the same manner as original appointments.
The Commission shall elect one of its members as chairman. A majority of the members of the Commission shall constitute a quorum.
The members of the Commission shall not receive any compensation for their services but shall be reimbursed for the reasonable and necessary expenses incurred in the discharge of their duties as provided in § 2.2-2825.
§ 2.2-2538. Duties of the Commission; limitation.
A. The Commission shall perform the following duties:
1. Annually review regulations to identify those regulations that may impede (i) the construction of any state or local transportation project or (ii) the maintenance of such transportation project.
2. Recommend to the Governor the suspension of any regulation that will cause additional cost to or delay of any state or local transportation project.
B. The provisions of this article shall not apply to any state safety regulations or safety inspection procedures.
§ 2.2-2539. Sunset.
This article shall expire on July 1, 2016.
