11101435DBe it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 8.01-226.8:1 as follows:
§ 8.01-226.8:1. Civil immunity for certain employers; firearms in employee's vehicle.
A. For purposes of this section, "employee's vehicle" means any vehicle used or operated by an employee that is not owned or leased by the employer.
B. Any employer who does not prohibit the storage of a lawfully possessed and transported firearm by an employee in the employee's vehicle while the vehicle is parked on the employer's property is not liable for any civil damages resulting from the storage or use of such firearm, including the theft of such firearm from the employee's vehicle, by a person other than the employer.
C. Nothing in this section shall be construed to impose any additional civil liability on an employer who prohibits employees from storing firearms in the employee's vehicle while such vehicle is parked on the employer's property.
