DMV offices and agencies; agreements.  Provides that in any county, city, or town that does not have either a branch office or an automated agency, the Commissioner shall, upon request of any commissioner of the revenue, treasurer, or local governing body, jointly or separately, enter into an agreement with such commissioner of the revenue, treasurer, or local governing body, to act as an agent of the Commissioner and maintain a branch office.

VDOT highway maintenance contracts.  Allows VDOT to contract with private entities for the maintenance of state-owned highway rights-of-way in return for the Department’s permission for display by the private entity of a single advertising sign, no larger than 18  inches x 24 inches, for each direction of traffic on the maintained portion of the right-of-way.

Highway maintenance allocations.  Provides that allocation by the Commonwealth Transportation Board for maintenance of assets within the Interstate System of Highways and the primary and secondary systems of state highways shall be based on achieving a minimal level of disparity among highway construction districts in meeting asset management performance standards established pursuant to § 33.1-13.02.

S.B. 1179 Trespassing vehicles; regulation of removal by localities.

Regulation of trespassing vehicles; localities. Provides that, when a local governing body regulates towing by ordinance, such ordinance shall permit the towing company to tow the vehicle at least 10 miles from the origination of the tow.

S.B. 1191 Motor vehicle dealers; requirements for obtaining a franchise, civil penalty.

Motor vehicle dealers and manufacturers.  Prohibits the requirement of site control agreements, franchise options, or advance voluntary termination as a condition of obtaining a franchise; protects motor vehicle dealers from requirements to construct improvements to replace recent improvements; clarifies the time within which a dealer may request a hearing in the event of a termination notice; prohibits the exercise of rights under a site control agreement, franchise options, or advance termination agreement that will result in the termination of the franchise of the dealer without a hearing to determine good cause if requested by the dealer; requires fair allocations of vehicles to same line-make dealers in the Commonwealth; requires a franchisor’s pecuniary interest in vendors that it designates; to require a franchisor to permit improvements by vendors of a dealer’s choice and to require disclosure of the franchisor’s pecuniary interest in vendors that it designates; and requires that in any hearing on a petition filed by a dealer that the franchisor has the burden of proof by a preponderance of the evidence.

 A BILL to amend and reenact §§ 46.2-1569 and 46.2-1573 of the Code of Virginia, relating to prohibited coercion of motor vehicle dealers; hearings and other remedies, and civil penalties related thereto.

S.B. 1225 DMV offices and agencies; agreements with commissioner of the revenue, treasurers, or localities.

DMV offices and agencies; agreements; compensation.  Provides that in any county, city, or town that does not have either a branch office or an automated agency, the Commissioner shall, upon request of any commissioner of the revenue, treasurer, or local governing body, jointly or separately, enter into an agreement with such commissioner of the revenue, treasurer, or local governing body, to act as an agent of the Commissioner and maintain a branch office. The bill also increases the compensation fixed for each nonautomated agency for the purpose of maintaining adequate annual service from 3.5 to 4.5 percent of the first $500,000 of gross collections made by the agency and increases the current two percent on gross collections between $500,000 and $1 million and one percent on gross collections over $1 million to five percent on all gross collections in excess of $500,000 during each fiscal year.

Commissioners of the revenue; powers and duties.  Provides additional powers and duties to local commissioners of the revenue. The bill would allow commissioners of the revenue to register dealers for sales tax purposes, audit records related to the collection of the sales and use tax, operate Department of Motor Vehicles "Select Services" branches, and verify that a taxpayer applying for a business license has any necessary state license from the Department of Professional and Occupational Regulation.

S.B. 1468 Rail Transportation Development Authority; established, abolishes Rail Advisory Board.

Rail Transportation Development Authority.  Establishes the Rail Transportation Development Authority. The Authority is to be responsible for identifying needed construction, reconstruction, improvements, or repairs to railroads and their facilities and equipment. The Authority is given the power to finance or assist in financing any such rail transportation project. The bill requires the Virginia Department of Rail and Public Transportation, in conjunction with the Authority, to develop a rail transportation plan for the Commonwealth. The bill further abolishes the Rail Advisory Board and repeals Chapter 1041 of the 2003 Acts of Assembly, which provided for the creation of a Rail Transportation Development Authority, but never became effective because it included a reenactment clause, and the act was not reenacted.

A BILL to amend and reenact § 2.2-2101, as it is currently effective and as it may become effective, and § 33.1-221.1:1.1 of the Code of Virginia; to amend the Code of Virginia by adding in Title 33.1 a chapter numbered 10.1:1, consisting of sections numbered 33.1-391.5:1 through 33.1-391.5:5; and to repeal § 33.1-391.3:1 of the Code of Virginia and Chapter 1041 of the Acts of Assembly of 2003, relating to the Rail Transportation Development Authority and the Rail Advisory Board.
