SUMMARY AS PASSED:
Criminal nonsupport. Clarifies that a parent who is not subject to prosecution for criminal nonsupport because his child receives aid under a federal or state program for aid to the permanently and totally disabled is subject to prosecution for desertion and nonsupport of a spouse and for any children who are not receiving such aid.
SUMMARY AS PASSED HOUSE:
Criminal nonsupport. Under current law a parent is not subject to prosecution for criminal nonsupport if the child receives aid under a federal or state program for aid to the permanently and totally disabled. This bill clarifies that such a parent is subject to prosecution for desertion and nonsupport of a spouse and of any children who are not receiving such aid.
SUMMARY AS INTRODUCED:
Criminal nonsupport; disabled parent. Provides that a parent who is permanently and totally disabled cannot be guilty of criminal nonsupport of his child if the child is in necessitous circumstances. Currently, only the parent of a child who is receiving aid from a federal or state agency cannot be guilty of criminal nonsupport..
