SUMMARY AS PASSED:

Funeral services; disposition of remains.  Requires a funeral services provider to refrigerate or, with the express permission from the next of kin, embalm human remains within 48 hours of the receipt of such remains. The bill also provides that a person designated in a signed and notarized writing shall take priority over next of kin in making funeral arrangements, and clarifies procedures where the deceased has designated a person to make arrangements for his funeral and disposition of his remains on a U.S. Department of Defense Record of Emergency Data.

SUMMARY AS PASSED HOUSE:

Funeral services; disposition of remains. Requires a funeral services provider to either embalm or refrigerate human remains within 48 hours of the receipt of such remains, and clarifies that a body shall not be embalmed and shall be refrigerated if the family of the deceased objects to embalming on the grounds that it conflicts with their religious tenets or practices. The bill also provides that a person designated in a signed and notarized writing shall take priority over next of kin in making funeral arrangements, and clarifies procedures where the deceased has designated a person to make arrangements for his funeral and disposition of his remains on a U.S. Department of Defense Record of Emergency Data.

SUMMARY AS INTRODUCED:

Funeral services; disposition of remains.  Requires a funeral services provider to either embalm or refrigerate human remains within 24 hours of the receipt of such remains. The bill also allows a designee to take priority over next of kin in making funeral arrangements, if such designee can provide a signed and notarized writing authorizing him to do so and is willing to take financial and other responsibility for the funeral and disposition of remains.
