SUMMARY AS PASSED:

Unlawfully obtaining or attempting to obtain controlled substances; report.  Provides that any person authorized to prescribe, dispense, or administer controlled substances pursuant to § 54.1-3408 who has reason to suspect that a person has obtained or attempted to obtain a controlled substance or prescription for a controlled substance by fraud or deceit may report the activity to the local law-enforcement agency for investigation. Any person who, in good faith, makes a report or furnishes information or records to a law-enforcement officer or entity pursuant to this section shall not be liable for civil damages in connection with making such report or furnishing such information or records.

SUMMARY AS PASSED HOUSE:

Unlawfully obtaining or attempting to obtain controlled substances; report. Provides that any person authorized to prescribe, dispense, or administer controlled substances pursuant to § 54.1-3408 who has reason to suspect that a person has (i) deceived a person authorized to prescribe, dispense, or administer controlled substances from whom he obtains or attempts to obtain a controlled substance or prescription for a controlled substance, or (ii) failed to report receipt of a controlled substance or a prescription for a controlled substance, may report the activity to the local law-enforcement agency for investigation. Any person who, in good faith, makes a report or furnishes information or records to a law-enforcement officer or entity pursuant to this section shall not be liable for civil damages in connection with making such report or furnishing such information or records.

SUMMARY AS INTRODUCED:

Unlawfully obtaining or attempting to obtain controlled substances; report required.  Provides that it shall be a Class 1 misdemeanor for any person to knowingly or intentionally deceive a prescriber in order to obtain a controlled substance or prescription for a controlled substance, or to fail to disclose to a prescriber from whom the person obtains or attempts to obtain a controlled substance or prescription for a controlled substance that the person has received the same or a similar controlled substance or a prescription for the same or a similar controlled substance within the previous 30 days. The bill requires any person authorized to prescribe, dispense, or administer controlled substances, who has reason to believe that a person has failed to make the required report, to report the incident to the local law-enforcement agency within three business days, and provides that persons making a report to a law-enforcement agency shall be immune from civil liability.
