SUMMARY AS ENACTED WITH GOVERNOR'S RECOMMENDATION:

Individual health insurance coverage; requirement to obtain.  Provides that a resident of the Commonwealth shall not be required to obtain or maintain a policy of individual insurance coverage except as required by a court or the Department of Social Services where the individual is named a party in a judicial or administrative proceeding. This applies regardless of whether the person has or is eligible for health insurance coverage under any policy or program provided by or through his employer or a plan sponsored by the Commonwealth or the federal government. The measure also states that no provision of Title 38.2 renders a resident liable for any penalty, assessment, fee, or fine as a result of his failure to procure or obtain health insurance coverage. The measure does not apply to individuals voluntarily accepting coverage under a state-administered Medicare or Medicaid program, or to students required by institutions of higher education to be insured as a condition of enrollment. The measure states that it does not impair the rights of persons to privately contract for health insurance for current or former family members. SB 283, SB 311 and SB 417 are identical.

Health insurance; Virginia Health Care Freedom Act. States that no law shall restrict an individual's right and power to choose private health care systems or private plans. The measure states that no law will infringe on an individual's right to pay for lawful medical services. The bill further states that no law shall impose a penalty, tax, or fine upon an individual who declines to contract for health care coverage or to participate in a health care system or plan, except as required by a court in a judicial dispute to which the individual is a named party. The measure does not apply to individuals seeking voluntary coverage under a state-administered Medicare or Medicaid program. HB 576 and HB 722 are incorporated.

SUMMARY AS INTRODUCED:

Health insurance; Virginia Health Care Freedom Act.  Protects an individual's right and power to participate or to decline to participate in a health care system or plan. The bill prohibits any law that will infringe on an individual's right to pay for lawful medical services. The bill further prohibits the adoption of any law that imposes a penalty, tax, or fine upon an individual who declines to enter into a contract for health care coverage or to participate in a health care system or plan.
