10104365DWHEREAS, Carleton Penn II, an admired and respected judge of the Circuit Court for Loudoun, Fauquier, and Rappahannock Counties, died on August 26, 2009; and
WHEREAS, a brilliant scholar, Carleton Penn received a bachelor’s degree and law degree from the University of Virginia; and
WHEREAS, between his studies, Carleton Penn was commissioned in 1943 at Quantico and assigned to the First Marine Division in the South Pacific; he landed in the fourth assault wave at Peleliu and was later wounded on Bloody Nose Ridge while directing artillery fire during that battle and was awarded the Silver Star and the Purple Heart; and
WHEREAS, after completing his studies, Carleton Penn became an associate of Elijah B. White in Leesburg before opening his own law office in 1950; and
WHEREAS, in 1952, Carleton Penn was appointed trial justice (now district judge) and Juvenile and Domestic Relations Court judge of Loudoun County, positions he held until 1958; and
WHEREAS, Judge Penn then served on the Condemnation Commission of the United States Court acquiring lands for Dulles Airport, the Dulles Airport Access Road, and other federal projects; and
WHEREAS, upon the death of the commonwealth’s attorney in 1968, Judge Penn was appointed to fill the unexpired term of the prosecutor; however, in 1970 Judge Penn was elected by the General Assembly to the bench of the Circuit Court for Loudoun, Fauquier, and Rappahannock Counties; and
WHEREAS, Judge Penn’s years on the bench were marked by great fairness in his decisions and courtesy to litigants and lawyers alike; he presided with great dignity and integrity over the Circuit Court for Loudoun, Fauquier, and Rappahannock Counties until his retirement in 1987; and
WHEREAS, Judge Penn continued to serve the Commonwealth as a retired judge in the courts of the circuit and other courts until 2004; and
WHEREAS, Judge Penn generously gave of his time and talents in the community, including serving as master of the Olive Branch Masonic Lodge, past president of the Leesburg Lions Club, and member of the board of the Peoples National Bank of Leesburg; and
WHEREAS, Carleton Penn will be fondly remembered and missed by his loving wife, Joan Legg Penn; his children, Carleton and Muffin; his grandsons, R. Penn Bain and Carleton Penn IV; his stepchildren, Lynne, Leslie, Stacy, Katherine, Mary, and John and their families; and his numerous friends and admirers; now, therefore, be it
RESOLVED by the Senate, the House of Delegates concurring, That the General Assembly mourn the passing of a public servant dedicated to the judicial system, the Honorable Carleton Penn II; and, be it
RESOLVED FURTHER, That the Clerk of the Senate prepare a copy of this resolution for presentation to the family of the Honorable Carleton Penn II as an expression of the General Assembly’s respect for his memory.
