Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding in Chapter 9 of Title 2.2 a section numbered 2.2-904.2 as follows:

§ 2.2-904.2. State agencies to waive fees for small businesses established by veterans.

A. As used in this section:

"Permit" means the whole or part of any state agency permit, license, certificate, approval, registration, charter, or any form or permission required by law, to engage in activity associated with or involving the establishment of a small business in the Commonwealth.

"Regulatory agency" means any state agency, board, commission, or division that regulates one or more professions, occupations, industries, businesses, or activities.

"Small business" means an independently owned and operated business that, together with affiliates, has 250 or fewer employees or average annual gross receipts of $10 million or less averaged over the previous three years.

"Veteran" has the same meaning assigned to it in § 2.2-2001.

B. Notwithstanding any provision of this Code to the contrary, each regulatory agency is authorized and directed to waive any requirement, established by statute or regulation, that an applicant for a permit pay any fee or other consideration as a condition for the regulatory agency's accepting, processing, or administering an application for, or for issuing, a permit whenever the applicant is a veteran and the permit is required by law for the establishment and operation of a small business that the veteran will own and operate.
