Be it enacted by the General Assembly of Virginia:

1.  That the second enactment of Chapter 18 of the Acts of Assembly of 2009 is amended and reenacted as follows:

That the regulation that establishes local program criteria and delegation procedures and the water quality and water quantity criteria, and that is referenced in subsections A and B of § 10.1-603.3 of this act, shall not become effective prior to July 1, 2010 2011. Any regulation adopted prior to this date shall be considered outside the scope of authority granted by the General Assembly.
