Be it enacted by the General Assembly of Virginia:

1.  That the Code of Virginia is amended by adding in Chapter 14 of Title 10.1 an article numbered 2.2, consisting of sections numbered 10.1-1413.3 and 10.1-1413.4 as follows:

Article 2.2.

Solid Waste Disposal Fees.

§ 10.1-1413.3. Per ton fee for disposal of solid waste.

The owner or operator of every solid waste management facility permitted to treat or dispose of solid waste and subject to the reporting requirements of § 10.1-1413.1 shall remit to the Department $2 for each ton of solid waste treated or disposed of at the owner's or operator's solid waste management facility during the previous three months. For facilities without a scale, two cubic yards of solid waste shall be the equivalent of one ton. Payment shall be made within 30 days of the end of each quarter, with the first payment due October 30, 2010. The provisions of this section shall not apply to construction demolition debris.

§ 10.1-1413.4. Receipt and allocation of fees.

The fees received by the Department shall be allocated in the following manner:

1. Five million dollars per year shall be allocated to carry out the provisions of the Virginia  Waste Management Act (§ 10.1-1400 et seq.); and

2. Any remaining funds shall be allocated for land conservation to be divided equally between the land conservation grant programs of the Office of Farmland Preservation established pursuant to § 3.2-201 and the Virginia Land Conservation Foundation established pursuant to Chapter 10.2 (§ 10.1-1017 et seq.) of Title 10.1.
