10102247DBe it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 23-122.2 as follows:
§ 23-122.2. Lease of certain property in possession or control of the University.
Notwithstanding the provisions of § 23-4.1, but subject to policies and procedures adopted by the board and with the approval of the Governor first obtained, the University may lease real property in its possession or control upon which a building to be substantially used for student housing is to be constructed or upon which is currently situated a building to be substantially used for student housing, provided that (i) the lease is to a recognized student organization for student housing; (ii) if the building has not been constructed or if renovations to a current building are required in order for it to be suitable for student housing, the University shall not directly or indirectly construct the building or make such renovations; and (iii) the building is in compliance with the Uniform Statewide Building Code. The University is further authorized to lease all or a portion of the building, to manage the operation and maintenance of the building, including the collection of any rental fees from students in connection with the use of the building, and to support activities at such building consistent with law. The University shall not be required to take any action hereunder that would constitute a breach of the University's obligations under any contract, instrument, or other legal document.
