Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 19.2-269.3 as follows:

§ 19.2-269.3. Certain confessions inadmissible if not videotaped.

No confession of a criminal defendant to the commission of any of the following criminal offenses shall be admissible in a court of law unless the confession is recorded on videotape and is otherwise admissible:

(i) forcible rape of an adult in violation of  § 18.2-61;

(ii) forcible sodomy of an adult in violation of § 18.2-67.1;

(iii) forcible object sexual penetration of an adult in violation of § 18.2-67.2;

(iv) robbery in violation of § 18.2-58 or carjacking in violation of § 18.2-58.1; or

(v) felony kidnapping or abduction in violation of Article 3 (§ 18.2-47 et seq.) of Chapter 4 of Title 18.2.
