Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 4.1-309.1 as follows:

§ 4.1-309.1. Possessing or consuming alcoholic beverage while operating a school bus; penalty.

Any person who possesses or consumes an alcoholic beverage while operating a school bus [ , as defined in § 46.2-100, while transporting children, ] is guilty of a Class 1 misdemeanor.
