10103654DBe it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 56-234.6 as follows:
§ 56-234.6. Information on energy conservation.
A. Each investor-owned electric utility and natural gas distribution company that is subject to regulation by the Commission shall provide information to its customers to support and encourage realistic conservation actions by customers.
B. By July 1, 2011, the Commission shall adopt regulations establishing requirements for the information to be (i) included with customers’ periodic bills, (ii) sent annually to customers in reports, and (iii) made accessible to customers on the Internet. Information included with customers’ periodic bills shall be information that may assist customers in evaluating their rate of consumption and comparing their rate of consumption to that of similar customers including normal use patterns and deviations from normal use patterns adjusted for factors that influence consumption rates such as weather, length of bill cycle or time between meter readings, and other relevant factors.
C. By January 1, 2012, each investor-owned electric utility and natural gas distribution company that is subject to regulation by the Commission shall submit to the Commission its plan to comply with the guidelines issued pursuant to subsection B. The plan shall include a timeline indicating when the utility or distribution company can begin providing the required information to its customers.
D. The Commission shall analyze and review the information plans submitted pursuant to subsection C and shall, after notice and hearing, (i) make a determination as to whether each plan is reasonable and in the public interest, and (ii) establish dates for the provision of the information.
2. That on or before January 1, 2011, the Commission shall issue the guidelines established pursuant to subsection B.
3. That on or before January 1, 2012, each investor-owned electric utility and natural gas distribution company that is subject to regulation by the Commission shall submit to the Commission its plan to provide customers with the required information pursuant to subsection C.
