Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 18.2-172.3 as follows:

§ 18.2-172.3. Criminal impersonation; penalty.

Any person who knowingly and without authorization assumes the identity of another and commits an act that, if done by the person whose identity is assumed, would subject such person to civil or criminal liability is guilty of a Class 1 misdemeanor.

For purposes of this section, a person "assumes the identity of another" when the offender creates a situation which would cause a reasonable person to believe the offender is in fact the individual whose identity is assumed.

The provisions of this section shall not apply to a law-enforcement officer, as defined in § 9.1-101, acting in the performance of his official duties.
