CHAPTER 854 An Act to amend the Code of Virginia by adding a section numbered 55-513.01, relating to the Property Owners' Association Act; authority of board of directors; parking. [H 1102] Approved April 21, 2010

 

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 55-513.01 as follows:

§ 55-513.01. Adoption of rules related to parking; apportionment of common expenses.

A. To the extent the declaration gives the board of directors the authority to adopt rules and regulations relating to the parking of motor vehicles by lot owners, such rules may establish a parking space designation plan which makes parking spaces available to less than all of the lot owners.

B. If such a plan is adopted, the common expenses attributable to such parking spaces may be specially assessed against the lot owners involved.

2. That the provisions of this act shall not become effective unless reenacted by the 2011 Session of the General Assembly.
