CHAPTER 807 An Act to amend and reenact § 3.2, as amended, of Chapter 618 of the Acts of Assembly of 1981, which provided a charter for the Town of Vinton, relating to vacancies on the council. [S 509] Approved April 21, 2010

 

Be it enacted by the General Assembly of Virginia:

1. That § 3.2, as amended, of Chapter 618 of the Acts of Assembly of 1981 is amended and reenacted as follows:

§ 3.2. Vacancies on council.

Vacancies on the council shall be filled within thirty forty-five days of when the vacancy occurs, for the unexpired portion of the term, by a majority vote of the remaining members of the council. If, however, the unexpired portion of the term is more than two years, the person appointed by council shall serve only until the next regular councilmanic election, at which time the vacancy shall be filled by the electorate. The person appointed by council shall hold office until the qualified voters fill the vacancy by special election pursuant to Article 6 (§ 24.2-225 et seq.) of Chapter 2 of Title 24.2 of the Code of Virginia (1950), and the person so elected has qualified.
