An Act to amend the Code of Virginia by adding a section numbered 62.1-44.38:2, relating to establishing the State Water Supply Plan Advisory Committee.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 62.1-44.38:2 as follows:

§ 62.1-44.38:2. State Water Supply Plan Advisory Committee established.

A. The State Water Supply Plan Advisory Committee (the Committee) is hereby established as an advisory committee to assist the Department of Environmental Quality in developing, revising, and implementing the state water resources plan. The Committee shall be appointed by the Director of the Department of Environmental Quality and shall be composed of nonlegislative citizen members representing industrial and municipal water users; public and private water providers; agricultural, conservation, and environmental organizations; state and federal agencies; and university faculty with expertise in water resources-related issues. The Committee shall meet at least twice each calendar year.

Members of the Committee shall receive no compensation for their service and shall not be entitled to reimbursement for expenses incurred in the performance of their duties.

B. The Committee shall examine: (i) procedures for incorporating local and regional water supply plans into the state water resources plan and minimizing potential conflicts among various submitted plans; (ii) the development of methodologies for calculating actual and anticipated future water demand; (iii) the funding necessary to ensure that the needed technical data for development of a statewide planning process; (iv) the effectiveness of the planning process in encouraging the aggregation of users into common planning areas based on watershed or geographic boundaries; (v) the impact of consumptive use and reuse on water resources; (vi) opportunities for use of alternative water sources, including water reuse and rainwater harvesting; (vii) environmental flows necessary for the protection of instream beneficial use of water for fish and wildlife habitat; (viii) the role of the State Water Control Board in complying with the state water resources plan; and (ix) other policies and procedures that the Director of the Department of Environmental Quality determines may enhance the effectiveness of water supply and water resources planning in Virginia.

2. That this act shall expire on December 31, 2012.
