SUMMARY AS INTRODUCED:
Assault and battery against a family or household member; authority to defer and dismiss. Provides that a court shall not defer disposition in and discharge and dismiss a criminal proceeding against a person for violation of § 18.2-57.2 (assault and battery against a family or household member) if it finds, among the facts that would justify a finding of guilt, that the accused, during the commission of such offense, knew that a third person, younger than 18 years of age, was physically present.
