HB 2141 Infectious disease; deemed consent for testing for HIV or hepatitis B or C, etc.
Introduced by: Jackson H. Miller | all patrons ... notes | add to my profiles | history
SUMMARY AS PASSED HOUSE:
Infectious disease; deemed consent for testing. Requires that if any salaried or volunteer firefighter, paramedic, or emergency medical technician becomes exposed to another's body fluids in a measure that may transmit HIV or hepatitis, the other person will be deemed to have consented to testing for those viruses. The bill also removes the duty of a law-enforcement officer to inform a person of his deemed consent prior to exposure to his body fluids.
SUMMARY AS INTRODUCED:
Infectious disease; deemed consent for testing. Eliminates requirement that, in other than emergency situations, a law-enforcement officer give notice that a person shall be deemed to have consented to testing and disclosure of test results for HIV and hepatitis B or C, when the officer is directly exposed to body fluids of a person in a manner that may transmit HIV or hepatitis B or C.
