SUMMARY AS PASSED HOUSE:
Elections; filling vacancies in certain local offices; special elections. Provides that vacancies in a governing body or elected school board shall be filled at the next ensuing November or May general election notwithstanding any other statutory or charter provision to the contrary; thus overriding charter provisions that may allow a governing body or school board to appoint a person to serve the entire remaining portion of a term. In the case of a vacancy in a local governing body, the local governing body may request a special election on a date prior to the next general election.
SUMMARY AS INTRODUCED:
Elections; filling vacancies in certain local offices; special elections. Provides that vacancies in a governing body or elected school board shall be filled by special election notwithstanding any other statutory or charter provision to the contrary; thus overriding charter provisions that may allow a governing body or school board to appoint a person to serve the entire remaining portion of a term. The bill preserves the current law exception for towns with a population of 3,500 or less that provides (i) there will be no special election and (ii) the appointee to fill such a vacancy will hold office for the remainder of the term.
