Be it enacted by the General Assembly of Virginia:

1.  That the Code of Virginia is amended by adding a section numbered 46.2-1078.1 as follows:

§ 46.2-1078.1.  Use of certain wireless telecommunications devices by certain persons prohibited.

Except for emergency 911 calls, no person shall use any cellular telephone, mobile telephone, or other hand-held wireless telecommunications device while operating a motor vehicle; however, the foregoing provisions of this section shall not apply to use of any cellular telephone, mobile telephone, or other wireless telecommunications device if such device is configured for hands-free operation.
