098822201Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding sections numbered 2.2-1201.2 and 2.2-4311.2 as follows:
§ 2.2-1201.2. Verification of the validity of social security numbers using E-Verify Program.
The Department shall develop a statewide personnel policy providing for a state agency to verify the social security numbers of newly hired employees using the E-Verify Program.
As used in this section, "E-Verify Program" means an Internet-based system operated by the Department of Homeland Security in partnership with the Social Security Administration to determine the validity of social security numbers.
§ 2.2-4311.2. Required contract provisions; verification of the validity of social security numbers using E-Verify Program.
All state agencies shall include in every contract a provision requiring the contractor, during the performance of this contract, to verify the social security numbers of newly hired employees using the E-Verify Program.
As used in this section, "E-Verify Program" means an Internet-based system operated by the Department of Homeland Security in partnership with the Social Security Administration to determine the validity of social security numbers.
2. That the provisions of this act shall become effective when (i) the General Assembly passes a joint resolution stating that it is the sense of the General Assembly that the E-Verify Program is fully functional and properly funded, and (ii) the Governor issues an executive order including a determination that the E-Verify Program is fully functional and properly funded.
