097813338Be it enacted by the General Assembly of Virginia:
1. § 1. Notwithstanding the provisions of § 32.1-102.3:2 of the Code of Virginia or the provisions of any current Request for Applications issued by the Commissioner of Health pursuant to § 32.1-102.3:2, the Commissioner of Health shall issue a Request for Applications for 100 new nursing facility beds in Planning District 8 no later than October 1, 2009.
The Commissioner shall authorize and accept applications for such 100 nursing facility beds provided that the design implements the Green House program nursing home model. If that criterion is met, the Commissioner may issue a certificate of public need for an increase of 100 beds in which nursing facility or extended care services are to be provided and to establish a new facility within Planning District 8.
Should the application be submitted by a not-for-profit institution operating health care facilities within Planning District 8, the Department of Medical Assistance Services is authorized to offer incentives to the institution of up to $2,000,000 or 20 percent of the capital costs of the facility, whichever is less. Funding shall be provided from the moneys and interest received from the imposition of civil penalties levied by the state on long-term care facilities found to not be in compliance with the requirements of federal or state law or regulation. These funds are currently designated for use for the Nursing Home Quality Improvement Program.
