A BILL to amend and reenact § 46.2-874 of the Code of Virginia, relating to maximum speed limits in business and residence districts; towns permitted to increase speed limits.

Be it enacted by the General Assembly of Virginia:

1.  That § 46.2-874 of the Code of Virginia is amended and reenacted as follows:

§ 46.2-874. Maximum speed limit in business and residence districts.

A. The maximum speed shall be 25 miles per hour on highways in business or residence districts, except on interstate or other limited access highways with divided roadways or nonlimited access highways having four or more lanes and all state primary highways. The speed limit on all nonlimited access highways having four or more lanes and all state primary highways shall remain as indicated by signs posted prior to July 1, 2005, unless changed as provided by law.

B. Notwithstanding the provisions of subsection A, the governing body of any town, following an engineering and traffic investigation by such town, may by ordinance increase the speed limit in business or residence districts from 25 miles per hour to 35 miles per hour for highways carrying high volumes of traffic provided no businesses or residences front the highway.
