Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 56-236.3 as follows:

§ 56-236.3. Electrical service provided to public schools and libraries.

A. As used in this section:

"Public library" means any free public library established by the governing body of a locality or otherwise subject to the provisions of Chapter 2 (§ 42.1-33 et seq.) of Title 42.1.

"Public school" means any building, structure, or other improved real estate used primarily for educational purposes, title to which is vested in a school board.

B. Notwithstanding any provision of this title that prohibits the subsidization of the costs of service for one class of customers by other classes of customers, any rate schedule that is adopted pursuant to § 56-585.1 or 56-585.3 after July 1, 2009, for an electric utility that is subject to regulation by the Commission shall provide that:

1. The electric utility shall not charge the owner or operator of a public school or public library for service provided to the public school or public library; and

2. An electric utility shall be entitled to recover the costs of providing service to a public school or public library that the electric utility is prohibited from charging to the owner or operator of the public school or public library through rates for service provided to other customers, whether of the same or another class, in such a manner that the Commission finds is lawful and in the public interest.
