AMENDMENT IN THE NATURE OF A SUBSTITUTE

A BILL to amend the Code of Virginia by adding a section numbered 46.2-726.1, relating to a surcharge for issuance or renewal of certain license plates by the Department of Motor Vehicles.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 46.2-726.1 as follows:

§ 46.2-726.1. Imposition and collection of transportation surcharge for issuance or renewal of certain license plates.

The Commissioner may impose and collect a reasonable fee not to exceed $10 per year for the issuance or renewal of any special license plate or any license plate bearing reserved numbers or letters. The fees collected by the Commissioner pursuant to this section shall be paid into the state treasury and shall be set aside as a special fund to be used to meet the expenses of the Department.

The provisions of this section shall not apply to any special license plate that (i) is issued free of charge; (ii) is not subject to any fees in addition to the prescribed fee for state license plates; or (iii) is subject to a one-time fee plus the prescribed fee for state license plates. Special license plates bearing reserved numbers or letters shall be subject to only one surcharge per year.
