Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 59.1-156.1 as follows:

§ 59.1-156.1. Biodiesel fuel; minimum content required; effective date.

By January 1, 2011, all diesel fuel sold or offered for sale in the Commonwealth to consumers for use in on-road internal combustion engines shall contain at least 2.0 percent, by volume, biodiesel fuel or green diesel fuel, as defined in § 45.1-394.
