AMENDMENT IN THE NATURE OF A SUBSTITUTE

A BILL to amend the Code of Virginia by adding in Article 1 of Chapter 9 of Title 15.2 a section numbered 15.2-926.3, relating to local governments; adoption of ordinances prohibiting delivery of unsolicited newspapers.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding in Article 1 of Chapter 9 of Title 15.2 a section numbered 15.2-926.3 as follows:

§ 15.2-926.3. Adoption of ordinances prohibiting delivery of unsolicited newspapers on private property under certain circumstances.

Any locality may adopt an ordinance making it unlawful for any publisher or distributor to deliver unsolicited newspapers on private property if the owner of the private property has notified the publisher or distributor of the newspaper in writing to cease delivery. Any penalty imposed pursuant to this section shall be in addition to any penalty imposed pursuant to a littering ordinance.
