Be it enacted by the General Assembly of Virginia:

1.  § 1. Assessment of limited English proficient students.

That local school divisions in the Commonwealth shall not be required to administer the ACCESS for ELLs test as the state-approved limited English proficiency assessment mandated for students pursuant to the federal No Child Left Behind Act for the 2009-2010 school year; rather school divisions may retain flexibility with the use of an alternative assessment.
