AMENDMENT IN THE NATURE OF A SUBSTITUTE

A BILL to amend the Code of Virginia by adding in Chapter 9 of Title 63.2 a section numbered 63.2-914, relating to the "A Place of My Own" Program.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding in Chapter 9 of Title 63.2 a section numbered 63.2-914 as follows:

§ 63.2-914. "A Place of My Own" program; Department to develop.

The Department shall take steps to identify and work together with faith-based, volunteer, private, and community-based organizations to develop and implement a program, to be known as the "A Place of My Own" Program (Program), to seek and accept donations and coordinate the distribution of luggage for children in foster care. The Department may accept grants, gifts, donations, and bequests to support the activities of the Program pursuant to this section.  

There is hereby created a special nonreverting fund to be known as the "A Place of My Own" Program Fund, hereinafter referred to as the "Fund." The Fund shall be established on the books of the Comptroller, and shall consist of grants, donations, and bequests from private sources. Such moneys shall be deposited into the state treasury to the credit of the Fund and shall be used solely to support the activities of the Program, pursuant to this section. Any moneys remaining in the Fund, including interest thereon, at the end of each fiscal year shall not revert to the general fund but shall remain in the Fund. The Fund shall be administered by the Department of Social Services.

2.  That the provisions of this act shall not become effective unless an appropriation of general funds effectuating the purposes of this act is included in the general appropriation act passed by the 2009 Session of the General Assembly, which becomes law.

3.  That the provisions of this act shall expire on June 30, 2012, if no moneys have been deposited into the A Place of My Own Program Fund, established pursuant to § 63.2-914 of the Code of Virginia.
