091524840Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 4.1-305.1 as follows:
§ 4.1-305.1. Permitting underage person to consume alcoholic beverages; penalty.
No person having possession of, or exercising dominion and control over, any dwelling or private real property shall (i) knowingly permit any person under the age of 21 to consume an alcoholic beverage in such dwelling or on such private real property or (ii) knowing that any person under the age of 21 is consuming an alcoholic beverage, in such dwelling or on such real property, fail to make reasonable efforts to halt such consumption. The exceptions in subsection A of § 4.1-305 shall apply to this section. A violation of this section is a Class 3 misdemeanor. A violation of this section involving consumption of alcohol by multiple persons under age 21 at a single event or occurrence constitutes one offense.
