098207824Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding in Chapter 9 of Title 9.1 a section numbered 9.1-923 as follows:
§ 9.1-923. Conviction and sentencing orders in contravention of the Sex Offender and Crimes Against Minors Registry Act.
[ A. ] Any provision in a conviction order, a sentencing order, or other court order or plea agreement stating that a person is not required to register with the Sex Offender and Crimes Against Minors Registry is invalid and void ab initio if such provision is in conflict with the provisions of this Act.
[ B. If the Department of State Police receives such an order or agreement specified in subsection A, the Department shall notify the chairmen of the House Committee for Courts of Justice, the House Committee on Militia, Police and Public Safety, and the Senate Committee for Courts of Justice, and the Executive Secretary of the Supreme Court of Virginia. The notification shall indicate the date of the order or agreement, the name of the judge issuing the order or approving the agreement, and the criminal history, to the extent available, of the individual subject to the order or agreement. ]
2. That this act is declaratory of existing law.
