089776688Whereas, it is in the interest of the Commonwealth to have a state lottery to produce much needed revenues for the purpose of public education in the Commonwealth; and
Whereas, it is in the interest of the citizens of the Commonwealth to be afforded access to quality education and educational facilities while being assured of the integrity of the operation of the state lottery; and
Whereas, it is the sense of the General Assembly that the state not directly control the operation of the state lottery but, instead, provide for the privatization of the administration of the lottery, all of which is in the public interest; now, therefore
Be it enacted by the General Assembly of Virginia:
1. § 1. That the State Lottery Board (the Board) shall, on or before December 1, 2009, complete an implementation study for the privatization of the administration of the state lottery in accordance with the provisions of this act.
§ 2. By December 15, 2009, the Board shall report to the Governor and the chairmen of the House Committee on Appropriations and the Senate Committee on Finance the results of its implementation study and make its recommendations to achieve the privatization of the administration of the state lottery.
§ 3. In the report required by § 2 of this act, the Board shall include the number of other states where administration of the state lottery has been privatized, the various models used by such states in privatizing their lotteries, the relative success of each such state's efforts in terms of revenue production, regulatory compliance by lottery retailers and vendors, and the Board's evaluation of each such model and state's experience. The report shall also include an implementation plan to achieve the privatization of the administration of the state lottery on or before July 1, 2011.
2. That an emergency exists and this act is in force from its passage.
