2009 SESSION
Be it enacted by the General Assembly of Virginia:
1. That § 62.1-73 of the Code of Virginia is amended and reenacted as follows:
§ 62.1-73. Appointment and removal of Virginia members of Commission.
In pursuance of Article IV of said compact there shall be
three members of the Ohio River Valley Water Sanitation Commission from
Virginia. Two members One member of the Commission shall be
appointed by the Governor, subject to confirmation by the General Assembly,
from the membership of the State Water Control Board continued under §
62.1-44.7. The terms term of the commissioners commissioner
shall be coincident with that of their terms his term upon the Commonwealth
State Water Control Board. All vacancies Any vacancy
in the office of any such the commissioner shall be filled by
appointment by the Governor. The third second Virginia member of
the Commission shall be the Director of the Department of Environmental
Quality. The third Virginia member shall be the Director of the Department
of Conservation and Recreation. Any member of the Commission appointed
pursuant to this section who cannot be present at a meeting of the Commission,
or at any committee or subcommittee of the Commission, may designate any
employee of the Department of Environmental Quality, the Department of
Conservation and Recreation, or a member of the State Water Control Board
to attend the meeting and vote on his behalf.
Any commissioner may be removed from office by the Governor.
2. That beginning July 1, 2009, one of the two members of the State Water Control Board serving as a commissioner shall be replaced pursuant to the provisions of this act.
