2009 SESSION
Be it enacted by the General Assembly of Virginia:
1. That § 46.2-341.18:01 of the Code of Virginia is amended and reenacted as follows:
§ 46.2-341.18:01. Disqualification for violation of out-of-service order; commercial motor vehicle designed to transport 16 or more passengers; commercial motor vehicle used to transport hazardous materials.
The Commissioner shall disqualify, for a period of two
years, any person convicted of violating an out-of-service order while
operating (i) a commercial motor vehicle designed to transport 16 or more
passengers, including the driver, for a period of two years or (ii)
notwithstanding the provisions of § 46.2-341.18, a commercial motor vehicle
while used in the transport of hazardous materials required to be placarded
under federal Hazardous Materials Regulations (49 C.F.R. Part 172, Subpart F).
If the person is convicted of two or more violations of this section, and each
offense arose from a separate incident committed within a period of 10 years,
the disqualification shall be for five years.
