C. Agencies and institutions that have initiated or are considering performance contracting energy efficiency measures shall be relieved of the provisions in §§ 2.2-1182 and 2.2-1183. Such agencies and institutions shall make reasonable efforts to incorporate the provisions of this article in performance contracting measures consistent with guidance from the Department of Mines, Minerals and Energy.
