Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 33.1-23.1:1.1 as follows:

§ 33.1-23.1:1.1. Allocations to certain counties for maintenance of certain state secondary highway system components; responsibility of certain counties for certain highway maintenance.

The Department of Transportation shall establish and annually update a maintenance index of the unit costs for labor, equipment, and materials used on state secondary highway system components functionally classified as local roads.  Using this index, the Commonwealth Transportation Board shall annually allocate, from the Highway Maintenance and Operating Fund, prior to making any allocations for maintenance of any other state-maintained highways, funds for the maintenance of state secondary highway system components functionally classified as local roads.  Counties receiving allocations under this section shall have the exclusive responsibility of maintaining the state secondary highway system components within their respective boundaries that are functionally classified as local roads, and shall use allocations made by the Commonwealth Transportation Board to them pursuant to this section for no other purpose.  All maintenance performed by counties pursuant to this section shall be performed in conformity with standards of the Virginia Department of Transportation.  No allocations shall be made pursuant to this section for (i) any state secondary highway system component that ceases to be functionally classified as a local road, (ii) any road within any county that has withdrawn from the state secondary system of highways, or (iii) any road in any town for the maintenance of which allocations are made pursuant to § 33.1-41.1.
