Be it enacted by the General Assembly of Virginia:

1.  That the Code of Virginia is amended by adding a section numbered 33.1-23.1:3 as follows:

§ 33.1-23.1:3. Park-and-ride facilities expansion fund created; allocations.

After making the allocations provided for in subsection A of § 33.1-23.1, but before making any allocations under subsections B 1, B 2, and B 3 of § 33.1-23.1, the Commonwealth Transportation Board shall establish a fund for expansion of park-and-ride facilities that are: (i) controlled by the Department and (ii) operating at, near, or in excess of capacity on peak-use days.  The Board shall annually allocate to this fund an amount calculated to be necessary to expand qualifying park-and-ride facilities to ensure that the expanded facilities would not operate at, near, or in excess of capacity on peak-use days.
