082611696Be it enacted by the General Assembly of Virginia:
1. § 1. That in order to provide a guide for the efficient and effective investment in public facilities, the General Assembly creates the 21st Century Capital Improvement Program ("Capital Improvement Program" or "CIP"), which is a dynamic program that will be revised annually for the acquisition, development, enhancement, planning, or replacement of public facilities over a multiyear period to serve the citizens of the Commonwealth of Virginia. By looking beyond year-to-year budgeting and creating a program that outlines Virginia’s capital needs, the Commonwealth will be able to maintain and deliver an effective level of service for present and future populations. The CIP will also provide for the orderly and systematic programming and financing of capital projects. The CIP will be developed in conjunction with the Commonwealth’s budget process.
§ 2. Scope and priority of funding.
The CIP will cover capital projects supported in whole or in part by general funds. Capital projects will be listed by agency, in agency-priority order. However, priority for funding will be determined by the General Assembly based upon projects that:
1. Have already received planning funds and have completed that process;
2. Impact life safety;
3. Upgrade major mechanical systems;
4. Renovate existing facilities;
5. Provide new construction that increases research capacity or enrollment capacity at institutions projected to grow;
6. Meet State Council of Higher Education for Virginia guideline parameters;
7. Improve energy efficiency; or
8. Have been reviewed and value engineered by the Department of General Services.
§ 3. Role of the State Council of Higher Education for Virginia.
The State Council of Higher Education for Virginia ("SCHEV" or "Council") shall develop policies, formulas, and guidelines for the fair and equitable distribution and use of public funds among the public institutions of higher education, taking into account enrollment projections and recognizing differences as well as similarities in institutional missions. Such policies, formulae, and guidelines as are developed by the Council for capital outlay programs shall be utilized by all public institutions of higher education in preparing requests for appropriations. The Council shall consult with the Department of Planning and Budget in the development of such policies, formulas, and guidelines to insure that they are consistent with the requirements of the Department of Planning and Budget.
Not less than 30 days prior to submitting its biennial budget request to the Governor, the governing board of each public institution of higher education shall transmit to the Council such selected budgetary information relating to its budget request for capital outlay as the Council shall reasonably require. Within five calendar days after institutions of higher education transmit such information to the Council, the Council shall submit, electronically if available, copies to the Chairmen of the Senate Finance and House Appropriations Committees. The Council shall analyze such information in light of the Council's plans, policies, formulae, and guidelines and shall submit to the General Assembly and the Governor recommendations for approval or modification of each institution's request together with a rationale for each such recommendation. The Council shall make available to the General Assembly its analyses and recommendations concerning institutional budget requests.
Nothing herein shall prevent any institution from appearing through its representatives or otherwise before the Governor and his advisory committee on the budget, the General Assembly, or any committee thereof at any time.
§ 4. Project Pre-planning
A. Projects included in the Commonwealth’s Capital Improvement Program shall be supported by pre-planning adequate to establish project size, scope, and cost. For those projects with a total cost exceeding $5 million, by October 1 of each year institutions shall provide to the Department of Planning and Budget, the Department of General Services, the State Council of Higher Education, and the Chairmen of the House Appropriations and Senate Finance Committees pre-planning or project feasibility studies that include the following:
1. Statement of program definition including functional space requirements, estimates of gross and net square footage, and functional adjacency requirements.
2. Analysis of program execution options including review of new construction versus renovation alternatives, necessary phasing or sequencing of the project, and coordination with other ongoing or proposed capital projects.
3. Site analysis including options considered and, for the site chosen, any specific issues related to topography, utilities, or environment.
4. Presentation including site plan, conceptual floor plans and elevations, and conceptual exterior.
5. Identification of any Uniform Statewide Building Code compliance or permit requirements unique to the project.
6. Cost estimate for the project to include total cost of the project, construction cost for the project, total cost per square foot, construction cost per square foot, costing methodology, and identification of any factors unique to the project that may impact overall project cost.
B. The Department of General Services shall by November 15 of each year review each institution’s pre-planning or project feasibility studies and provide to the Department of Planning and Budget, the Chairs of the House Appropriations and Senate Finance Committees, and the institution an assessment of the cost estimate and costing methodology reflected in each study. If there is a difference in the cost estimates of the institution and the Department of General Services, the institution shall have the opportunity to provide to the Department of Planning and Budget and the Chairs of the House Appropriations and Senate Finance Committees additional information in support of its estimate.
C. It shall be the policy of the Commonwealth that, during the development of preliminary and working drawings, any capital project with a total cost exceeding $5 million as included in the Commonwealth’s Capital Improvement Program be subject to value engineering. Value engineering means a systematic process of review and analysis of a capital project by a qualified value engineering team. Such team, which shall include appropriate professionals licensed in accordance with Chapter 4 (§ 54.1-400 et seq.) of Title 54.1 of the Code of Virginia, may offer suggestions that would improve project quality and reduce total project cost by combining, eliminating, redesigning, or otherwise identifying potential changes to the construction program as initially proposed. Each institution shall retain for each project documentation of the value engineering process including items accepted, rejected, and any savings that result.
D. Determination of the construction method for each project shall be at the discretion of the institution or agency. Whenever design-build or construction management is used for the construction of a facility, the entity constructing such facility shall in its procurement affirmatively consider that for years the Commonwealth did not allow or encourage construction management or design-build, thus limiting the ability of Virginia-based contractors to have as much experience under construction management or design-build as competitors working in the private sector and other public sector jurisdictions. A Virginia-based contractor who does not have the same number of years of comparable experience under construction management or design-build shall not be penalized for having less comparable experience in construction management or design-build projects, provided such contractor does have experience with constructing comparable projects under design-bid-build. The entity shall consider the experience and quality of work that a firm has done on comparable projects, whether under construction management, design-build, or design-bid-build. These factors shall be considered by the entity in making its decisions in a pre-qualification or a contractor selection process.
§ 5. Agency proposed revisions to projects.
State agencies and institutions of higher education shall annually submit any revisions that they have to projects that are in CIP. The agencies shall submit these revisions to the Governor and the Chairmen of the House Appropriations and Senate Finance Committees by October 1 of the year immediately prior to the beginning of each regular session of the General Assembly. The agencies shall include:
1. Changes in cost estimates;
2. Changes in project priority with an explanation for the change;
3. Changes in evaluations from SCHEV or DGS on existing projects; and
4. Pre-planning studies pursuant to § 3 of the fifth enactment of this Act.
§ 6. Governor's submission of proposed new projects.
At the same time that the Governor submits the Executive Budget, or amendments to the general appropriation act, prior to the beginning of each regular session of the General Assembly, the Governor shall submit to the members of the General Assembly for their consideration any new projects to be added to the CIP. The submission shall:
1. Identify each capital outlay project;
2. Describe the scope and nature of the project;
3. Provide an estimate of the total cost of each project upon payment in full;
4. Detail, by fiscal year, the source or sources of funds recommended for each capital outlay project;
5. Explain the specific criteria or justification that was used in determining the fiscal year in which funds were allocated to projects; and
6. Include any other information as may be requested by the General Assembly.
§ 7. Legislative intent for amounts appropriated.
1. a. If bids for projects funded under this program are in excess of the funding provided by the General Assembly, agencies and institutions are authorized to supplement projects from other fund sources such as private funds, gifts, grants, auxiliary funds, or federal funds as appropriate.
b. In the event agencies or institutions are unable to supplement projects from sources specified in subdivision a, agencies and institutions are authorized to reduce the size and the scope of the project as necessary to remain within the available funds appropriated, provided that they have completed a value engineering review by or in collaboration with the Department of General Services, and report the proposed reduction to the Governor and to the Chairmen of the House Appropriations and Senate Finance Committees.
2. Agencies are permitted to seek a supplemental appropriation through the executive budget process provided, however, that they (i) certify that alternative funding as outlined in subdivision 1 a is not available and (ii) submit to the House Appropriations Committee, Senate Finance Committee, Department of General Services, Department of Planning and Budget, and the State Council of Higher Education (for institutions of higher education only) an analysis of what the reduced project would be as well as a justification for why the change in size and scope cannot be achieved.
2. § 1. That to begin the 21st Century Capital Improvement Program's selection of capital improvement projects, the General Assembly designates the following projects.

3. § 1. 4. § 1. That pursuant to § 23-30.28 of the Code of Virginia, the General Assembly hereby authorizes the Virginia College Building Authority to undertake the following projects including, without limitation, constructing, improving, furnishing, maintaining, acquiring and renovating buildings, facilities, improvements, and land therefor; to exercise any and all powers granted to it by law in connection therewith, including the power to lease such projects to institutions of higher education of the Commonwealth; and to finance all or any portion of the cost thereof by the issuance of revenue bonds in a principal amount not to exceed $533,449,643 plus amounts needed to fund issuance costs, reserve funds, original issue discount, interest prior to and during acquisition, construction or renovation and for one year after completion thereof, and other financing expenses.
The Authority may pay all or any part of the cost of any project hereinafter listed or authorized or any portion thereof with any income and reserve funds of the Authority available for such purpose, and in such case may transfer such funds of the Authority, with the approval of the Governor.

5. §1. Pre-planning for Projects (FY 2009) -- The following projects have been approved for pre-planning as outlined in § 4 of the first enactment of this act. Funding for the project pre-planning will be provided as specified in the appropriations act for the fiscal year ending June 30, 2009. The Virginia College Building Authority is authorized to issue revenue bonds in a principal amount not to exceed $550 million in 2010 for the construction of these projects conditioned on approval of the plans by the General Assembly in the 2009 Session of the General Assembly and passage of amendments to the appropriation act. Pre-planning studies shall be submitted on or before October 1, 2008 to the Governor, the Department of General Services, the Department of Planning and Budget, the State Council on Higher Education in Virginia, and to the Chairmen of the House Appropriations and Senate Finance Committees.

§ 3. Institutions and agencies may request authority and appropriation to conduct planning for any project listed in the second enactment of this act using nongeneral fund sources. Such amounts may be reimbursed up to the lesser of $250,000 or one percent of the project construction costs.
6. That § 2.2-1509 of the Code of Virginia is amended and reenacted as follows:
§ 2.2-1509. Budget bill.
A. (Effective until July 1, 2008) On or before December 20 of the year immediately prior to the beginning of each regular session of the General Assembly held in an even-numbered year, the Governor also shall submit to the presiding officer of each house of the General Assembly, at the same time he submits "The Executive Budget," copies of a tentative bill for all proposed appropriations of the budget, for each year in the ensuing biennial appropriation period, which shall be known as "The Budget Bill." "The Budget Bill" shall be organized by function, primary agency, and proposed appropriation item and shall include (i) an identification of, and authorization for, common programs and (ii) the appropriation of funds according to programs. Strategic plan information and performance measurement results developed by each agency shall be made available to the General Assembly as it considers "The Budget Bill." Except as expressly provided in an appropriation act, whenever the amounts in a schedule for a single appropriation item are shown in two or more lines, the portions of the total amount shown on separate lines are for information purposes only and are not limiting. No such bill shall contain any appropriation the expenditure of which is contingent upon the receipt of revenues in excess of funds unconditionally appropriated.
A. B. The salary proposed for payment for the position of each cabinet secretary and administrative head of each agency and institution of the executive branch of state government shall be specified in "The Budget Bill," showing the salary ranges and levels proposed for such positions.
C. "The Budget Bill" shall include all proposed capital appropriations, including each capital project to be financed through revenue bonds or other debt issuance, the amount of each project, and the identity of the entity that will issue the debt.
D. Concurrently with the submission of "The Budget Bill," the Governor shall submit a tentative bill involving a request for authorization of additional bonded indebtedness if its issuance is authorized by, or its repayment is proposed to be made in whole or in part, from revenues or appropriations contained in "The Budget Bill."
E. On or before December 20 of the year immediately prior to the beginning of each regular session held in an odd-numbered year of the General Assembly, the Governor shall submit to the presiding officer of each house printed copies of all gubernatorial amendments proposed to the general appropriation act adopted in the immediately preceding even-numbered year session. In preparing the amendments, the Governor may obtain estimates in the manner prescribed in §§ 2.2-1504, 2.2-1505, and 2.2-1506. On the same date he shall also submit a tentative bill during the second year of the appropriation period, a request for authorization of additional bonded indebtedness if its issuance is authorized by, or its repayment is proposed to be made in whole or in part, from revenues or appropriations contained in the proposed gubernatorial amendments.
F. The proposed capital appropriations or capital projects
described in, or for which proposed appropriations are made pursuant to, this
section shall include the capital outlay projects required to be included in
"The Budget Bill" pursuant to § 2.2-1509.1 law. The
Governor shall propose appropriations for such capital outlay projects in
"The Budget Bill" in accordance with the minimum amount of funding
and the designated sources of funding for such projects as required under §
2.2-1509.1.
7. That §§ 2.2-1503.2, 2.2-1509.1, and 2.2-1514, as it is currently effective and as it may become effective, of the Code of Virginia are repealed.
8. That an emergency exists and this act is in force from its passage.
