SB 171 Adoption; former adoptive parent who stood in loco parentis may petition to adopt child.

SUMMARY AS PASSED:

Adoption by former stepparents.  Allows former step-parents to adopt the child they were a stepparent to, if they stood in loco parentis to the child, as if they were still the stepparent of the child.  Also allows parents who adopted a child in a foreign jurisdiction, who then divorced before the child was adopted in Virginia, to adopt or readopt the child.

 

SUMMARY AS PASSED SENATE:

Adoption by former stepparents.  Expands the exception to the divestiture of parental rights of a birth parent or parent by previous adoption applicable in cases of stepparent adoptions to cases where a former stepparent petitions to adopt a child, provided the former stepparent stood in loco parentis of the child during the petitioner's marriage. The bill clarifies that in no case shall a child be permitted to have more than two living parents.
