SUMMARY AS INTRODUCED:
Criminal procedure, admission to bail; persons not lawfully present in the United States; presumption. Adds a presumption, subject to rebuttal, against admitting to bail any person who is charged with a crime and not lawfully present in the United States, and requires judicial officers prior to any bail hearing, to the extent feasible, to verify with the United States Bureau of Immigration and Customs Enforcement whether a person is lawfully present in the United States. This bill was incorporated into HB 440 (Rust).
