SUMMARY AS PASSED HOUSE:
Malpractice actions; limitation. Extends the two-year limitations period for personal injury actions in malpractice cases arising out of the negligent failure to diagnose a malignant tumor or cancer or to communicate such diagnosis to the patient for a period of one year from the date the existence of a malignant tumor or cancer is communicated to the patient.
SUMMARY AS INTRODUCED:
Malpractice actions; limitation. Extends the two-year limitations period for personal injury actions in malpractice cases arising out of the negligent failure to diagnose disease or illness or to communicate such diagnosis to the patient for a period of one year from the date the disease or illness is communicated to the patient. The bill also provides that the determination of whether a personal injury action may be brought after the person's death where no action was pending at the time of death is governed by the personal injury limitations period.
