SUMMARY AS PASSED HOUSE:
Trail activity; immunity. Allows localities to establish a system of trails for ATVs and motorcycles and provides immunity for the locality in the absence of gross negligence or willful misconduct, for damages resulting from injuries from the use of such system.
SUMMARY AS INTRODUCED:
Trail Activity; immunity. Provides that a person who invites the public onto his land for the purpose of riding ATVs on a trail, whether for profit or not, is immune for simple negligence should an injury result from the same. The language very closely tracks the language from the Equine Activity Liability Act passed by the General Assembly in 1991.
