086126336Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 19.2-11.02 as follows:
§ 19.2-11.02. Prohibition on investigating victim and witness's immigration status.
When a person reports to law enforcement that he was a victim of or witness to a crime, neither the law-enforcement officer nor any other public officer or official may question the person as to whether the person making the report or any member of his immediate family, other than a member whom the reporter identifies as the alleged perpetrator of a crime, is a citizen or is otherwise lawfully present in the United States and the law-enforcement officer or other public officer or official may not investigate or cause to be investigated the immigration or legal status of such victim or witness.
