Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 23-2.1:3 as follows:

§ 23-2.1:3. Students' high school records.

1.  Each public institution of higher education shall, and each private institution of higher education may, request from the originating school a complete student record, including any mental health records held by the school, of each student accepted to such institution. These records shall be kept confidential as required by state and federal law, including the Family and Educational Rights and Privacy Act, 20 U.S.C. § 1232g.

2.  Any public institution of higher education shall require, and any private institution of higher education may, require, as a condition of matriculation (but not admission), a potential student and/or parent execute limited privacy waiver to provide mental health records.
